The terms on which this site is made available. Short, because a website is a small thing to agree about — the work itself is governed by the agreement signed for it.

Who these terms are from

This site, noemo.se, is published by Noemo Sverige, a business in the process of being registered in Sweden, at Hovslagargatan 29, 194 31 Upplands Väsby, Sweden. Its organisation number and VAT number are in process and will be published here once issued. In this document “we” and “us” mean Noemo Sverige, and “you” means whoever is using the site.

Accepting them

Using the site means accepting these terms. If you do not accept them, the remedy is not to use it.

Two other documents sit beside this one and are part of the same arrangement: privacy policy and cookie policy.

What this site is

This site describes what the studio does and shows work it has done. It is information, not an offer capable of acceptance: prices, timeframes, capacity and service descriptions here are indicative, and nothing on the site forms a contract until we have agreed one with you in writing.

We take care that what is published is accurate and current, but we do not warrant that it is either. A case study is an account of a project, not a promise of the same result for you.

What belongs to whom

Everything on this site — text, layout, typography, photography, film, illustration, code, and the Noemo name and mark — is owned by us or used with the owner's permission, and is protected by copyright and trade mark law.

Client names, logos and work shown here belong to those clients and appear with their agreement. Nothing on this page grants you any right to use them.

You may read the site, print or save pages for your own reference, and link to it. Anything else — copying, republishing, adapting, or using any part of it commercially — needs our written permission first, and we expect any permitted use to credit the source.

How you may use it

The site is open to anyone. These are the few things that are not allowed:

  • Anything unlawful, or anything that infringes someone else's rights.
  • Attempting to reach parts of the site, its server or connected systems that are not open to you.
  • Interfering with the site's operation — denial of service, malware, or automated load that degrades it for others.
  • Systematic scraping, harvesting or bulk extraction of content, including for building or training a dataset or a model, without our written permission.
  • Framing or mirroring the site, or removing any notice of ownership from material taken from it.

We may restrict access where one of these is happening.

What you send us

When you send us a project brief or write to us, you confirm that what you send is yours to send, that it is accurate, and that you have the right to give us the contact details in it.

An enquiry is not confidential unless we have signed something that makes it so, and we are glad to sign one before you send anything sensitive. So please do not put trade secrets, credentials, personal data about other people, or anything under someone else's non-disclosure agreement into a first message.

Ideas and suggestions you volunteer about our own work, unprompted, we may use without owing you anything for them. This is not a claim on your project; it is the ordinary clause that stops an unsolicited idea becoming a claim later.

What happens to the personal data in an enquiry is set out in privacy policy.

Availability

We would like the site to be up all the time, but we do not guarantee it. It may be unavailable for maintenance, for a provider's outage, or for reasons outside our control, with or without notice.

We may change, move or withdraw any part of the site at any time. Nothing here is promised to remain where it is.

Client engagements

These terms govern the site. They do not govern the work.

Every project we take on is governed by its own written agreement — scope, fee, schedule, ownership of the deliverables, confidentiality, and what happens if either side wants out. Where anything in that agreement differs from anything on this page, the agreement wins for that project.

Where we process personal data on a client's behalf as part of a project, we do so as a processor under a separate data processing agreement, and not under the privacy policy on this site, which covers data we hold as controller.

Liability

The site is provided as it is. To the extent Swedish law allows, we exclude implied warranties about it, including that it will be uninterrupted, error-free or fit for a particular purpose.

We are not liable for indirect or consequential loss arising from your use of this site — lost profit, lost business, lost data or lost goodwill. Where we are liable despite that, our total liability in connection with the site is limited to what you have paid us for access to it.

Nothing here excludes or limits liability that cannot lawfully be excluded: liability for death or personal injury caused by negligence, for fraud, or for gross negligence or intentional wrongdoing. If you use the site as a consumer, your mandatory rights under Swedish consumer law are unaffected by anything on this page.

Changes to these terms

We may revise these terms. The version that applies to you is the one published when you use the site, and the date at the top of this page is always the date of the current version.

Where a change is material we will say so on the site rather than leave you to compare dates.

Law and disputes

These terms, and any dispute arising out of them or out of your use of the site, are governed by Swedish law, without regard to its conflict of law rules.

Disputes are to be settled by the Swedish courts, with Stockholms tingsrätt as the court of first instance. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, or of your right to bring proceedings there.
